Death of Amish Man on Highway 63 Ruled a Homicide, Police Want Cell Phone Records

According to the story in the Hannibal Courier-Post, police have ruled it a homicide. Jeffrey David Fleming, a 34-year-old from Staunton, Illinois, was the driver of the car that rear-ended Borntrager. He has denied talking on the phone or texting at the time of the accident, but authorities are trying to subpoena his cell phone records.
Said the Randolph County Coroner Gerald Luntsford:
"[Fleming] made no effort to miss the cart, whatsoever...With what evidence we have, I had no other choice but to rule it a homicide."Fleming hit the young Amish man driving at about 70 mph. It's still undetermined whether the county prosecutor will file criminal charges.
