Preservationists Lose Court Appeal Over San Luis Apartments

The Missouri Court of Appeals upheld a circuit court's decision yesterday that a group of preservationists had no right to sue over the demolition of the San Luis apartments on Lindell Avenue.

The 1960s-era building was owned by the Archdiocese of St. Louis that razed the building last year to make room for a parking lot. The so-called "Friends of the San Luis" filed suit to block the demolition but the St. Louis Circuit Court dismissed the suit on grounds that the group had no economic interest in the case.

In a 13-page decision, the appellate court ruled that the Friend's case is moot because the building is already torn down. (Daily RFT made a similar ruling last summer.) The court did not rule on the larger question as to whether or not a group with no financial stake in a project can sue to stop the demolition of a historic building.

So, will this be the last we hear about the aesthetically questionable San Luis apartments?

Perhaps not. An attorney for Friends of the San Luis tells St. Louis Public Radio that his group may ask the Missouri Supreme Court to review the case.
