Brian Nieves' Wife Subpoenaed to Testify in Husband's Adult Abuse Case

The attorney representing political campaign worker Shawn Bell in an adult abuse case against state Rep. Brian Nieves (R - Washington) has subpoenaed Nieve's wife, Julie, to testify at a court hearing Thursday.

Bell, of Jefferson City, filed for an order of protection against Nieves in Cole County after complaining that the current Republican Whip in the House -- and G.O.P. candidate for state Senate -- assaulted him this month.

Bell's attorney, Michael Byrne, tells Daily RFT that the subpoena for Julie Nieves was delivered last Thursday to the couple's home. Byrne says he has no reason to believe that she won't show up in court in Cole County this week. The hearing is slated for 2 p.m. September 2 in front of Judge Jon Beetem.

Byrne says he has not subpoenaed another alleged witness -- Nieves' campaign worker Dave Bailey -- who Bell claims sat by idly during the assault.

According to a police report filed in Franklin County this month, Bell dropped by Nieves' Washington, Missouri, campaign office on August 3 to congratulate a fellow campaign worker on Nieves' victory in the primary. Bell claims that once Nieves saw him in the office, he threatened him with a gun, physically assaulted him and held him hostage.

While allegedly detained by Nieves, Bell claims he was also forced to apologize to Julie over the phone for a letter circulated during the campaign accusing Nieves of marital infidelity. (Bell had worked for one of Nieves' Republican challengers in the primary, Dick Stratman.)

In the police complaint, Bell writes of his encounter with Brian and Julie Nieves:
"I told him (Nieves) that the neither Dick nor I had anything to do with the letter accusing him of infidelity. He said that it came from someone from my team. He then said I was going to apologize to his wife for all the pain I caused her. He dialed a number on a white cordless (not cell) phone. No one answered and he called another # and Julie Nieves answered and he told her that a young man wanted to tell her something. Before I spoke to her he informed me if I wasn't sincere that he would drag me into the other room again and would wear me out. I apologized on the phone to Julie Nieves for some time and she mostly spoke but I was mainly focused on Brian staring and going through my cell phone messages. After we were done on the phone I asked him if it was sincere and he said from what I heard it did."
