Camp Zoe, Site of Schwagstock, Facing Seizure After Drug Investigation

The DEA, Missouri State Highway Patrol and U.S. Attorney's Office are trying to seize Camp Zoe, a 350-acre campground in central Missouri that hosts the music gathering Schwagstock -- after a four-year-long investigation allegedly uncovered rampant drug use and sales on the property.

According to a complaint filed November 8 in Eastern Missouri District Court, "over the past several years law enforcement agents have specifically observed the open sales of cocaine, marijuana, LSD (acid), ecstasy, psilocybin mushrooms, opium and marijuana-laced food products by individuals attending the music festival and made multiple undercover purchases of illegal drugs."

The paperwork shows that the authorities hope to use a mechanism called asset forfeiture to take the property. Under a forfeiture, they would not need to convict the property's owners of a crime -- or even charge them with one. The burden of proof is much lower.

The Camp Zoe property is located about 150 miles southwest of St. Louis near the town of Salem. It is owned and operated by Jimmy Tebeau, a member of the local Grateful Dead tribute band The Schwag. The complaint alleges that Tebeau -- who has not been charged with a crime -- and other Camp Zoe staff members were "in the immediate area" when the drug deals went down and "took no immediate action to prevent the activity."


Tebeau has not returned calls seeking comment on the government's claims. Joe Grasso, the booking agent for The Schwag, declined to comment. Grasso says his contract expired and he is no longer the Schwag's booking agent.

According to the Camp Zoe website, Tebeau purchased the land, took up residence there and started hosting the Schwagstock festivals in spring of 2004. The camp has also been the site of the Pagan Spirit Gathering, the Bluegrass Jam, Biker rallies and Gateway Burners, a gathering similar to Burning Man.

Schwagstock 45 was held earlier this year on September 17 and 18. The complaint reveals that "undercover purchases have been made as recently as September, 2010" but also says the investigation stretches all the way back to 2006 and includes evidence from "surveillance, undercover operations, source information, bank records, and interviews."

Asset forfeiture, according to the Department of Justice website, "enhances public safety and security," by "removing the proceeds of crime and other assets relied upon by criminals and their associates to perpetuate their criminal activity against our society."

In other words, if someone's car, home, or other assets are used to commit a crime, the DEA and other law enforcement agencies have the power to confiscate that property. They can then auction those items off and use the proceeds to fund their budgets. The complaint filed earlier this week says the Camp Zoe property has an approximate value of $600,000.

Since Tebeau himself has not been charged with a crime, the Camp Zoe case falls under the category of "civil forfeiture." That means the before the court issues a "certificate of forfeiture" to make things official, the government has to show a "preponderance of evidence" that the property was part of criminal activity.

In Tebeau's case, the U.S. Attorney's office alleges that Camp Zoe was "knowingly opened, rented, leased, used, or maintained for the purpose of manufacturing, distributing or using controlled substances."

the only thing you need to think about is why would they target camp zoe.... why not Bonneroo or any other $250 weekend festival... they took all revenue from the gate right... well they could have made out with a little more(about fifty times more) from the other festivals but the main reasons fall under who's land is it, are they leasing it, how hard it would be for us to seize it. Schwagstock was the easiest bust that they could have gone with so the pussy law enforcment people took it...

That's absurd. I know several people who go just to buy drugs. It definitely needs some cleaning up so people who truly care about the music can come and actually enjoy it instead of being surrounded by drug dealings. I don't go simply because I know there will be a lot of fucked up people who go for just that. So, YOU can suck a big one.

Camp Zoe was an amazing get away. the culture, the music, the people. everything was amazing. it was one of the greatest experiences of my life. AND NO I AM NOT A DRUG ADDICT. I never once did any drugs illegal or otherwise while attending Schwag. I dont care what anyone says, yes so there may have been drug usage but try and find a concert where there isnt any. i went for the good times. and there were alot of people there like me who didnt do drugs and just wanted to get away from the everyday crap. people there were so friendly and non judgemental. so RIP Schwagstock.... you will be greatly missed.

I'm from IL I camp with my mom and 2 girls at Camp Zoe at least twice a year. I go there for the nature. There is a freedom there that is very relaxing. I don't do drugs and have never been approached to buy drugs. There are drugs everywhere if you look.You the goverment need to QUIT trying to control everybody and everything. I have never been to one of the festivals at Zoe but I, like others, enjoy this area for different reasons so just stop..............

Absolute craziness. I live on the West Coast and listened for a few years while a friend in MO tried to convince me to fly in for Schwagstock with her and a friend. I opted out precisely because I was sure Camp Zoe would turn out to be a seedy drug paradise. I finally relented because I trusted this friend very much and knew she'd keep me safe.

What I found was an intriguing mix of everything everyone here has been saying. I chose to fly out chiefly because of the music and friendship, and believe me, that can be found at Schwagstock in spades. I remember waking up early Saturday morning during one Schwag and walking all over the campgrounds, visiting and talking with whoever would have me as company. It was crazy meeting all those awesome people, many of whom offered me breakfast and refreshment while they asked me about my life back in California (I am an honors graduate student attending school full time and working part-time as a tutor). The feeling that I was just a human being interacting with other warm, open human beings was overwhelming.

I won't lie - I smoked a bit of pot the night of the big music events and dropped my very first tab of acid ever (I'm 26 with a rewarding career that I love and thus can look at most recreational drugs with the proper critical lens and respect). But I was so freakin' QUIET about it! I was paranoid about police intervention or something similar happening even though my friend kept telling me there had never been a problem with cops, and so I did everything within the privacy of my tent and only hit the music scene when I was coming down off a wonderful trip. My point is that drug use is an inescapable part of any gigantic music event like this, and we the concert-goers can do TONS to help manage this. Even though I had the most memorable night of my life at Schwag (I met and danced with the most beautiful fairy nymph I've ever seen in one of the trance tents), I couldn't help but feel that a lot of the attendees were being stupid jag-offs when they went screaming down Shakedown that they loved molly but needed more shrooms. I saw this coming and will be unable to fly out for any Schwagstock in the foreseeable future because of this shut-down.

I agree that the seizure of the land is perhaps taking unnecessary measures, but I also think that beautiful events like Schwagstock can continue be beautiful if everyone worked a little harder to police THEMSELVES.

When I first heard about Schwagstock in early 2009 I was very apprehensive about attending (I initially completely refused to go). In my mind I could visualize a hippie tripping on acid, stumbling into my tent, and attempting to rape me in my sleep. Oh how wrong I had been and my friends still laugh about it till this day. Despite my pure hatred for bugs and the outdoors, I went in the Spring of 2009.

The initial shock upon arrival never dissipates, even year after year; and I am not referring to the culture, but the environment as a whole. Honestly, I do not smoke marijuana or use any other illegal substances, although they are easily accessible at Camp Zoe. My point being that you do not need the use of drugs or alcohol to appreciate what Zoe has to offer. Time seems to come to a screeching halt when you are at Camp Zoe; you can spend your nights watching movies projected onto a rock face, listen to drums being played inside a cave, and lay on grass while counting stars. Please do not get me wrong, I am not dismissing the fact that there are a lot of other things going on, but Camp Zoe really is a home away from home. You are surrounding by a thousand people that are quiet, relaxing, and not strutting around in an Affliction tee trying to pick a fight with everyone they run into.

In the matter of this case, I agree with ALL of you. Schwagstock is good and bad. But the outcome thus far does not seem fair. I know that laws can be changed or manipulated at any time and for any reason, and let’s face it, I’m sure that everyone will agree that if the government wants anything bad enough, they can get it. Just like parents being arrested for allowing their children to have parties at their homes, the parents may not be providing drugs or alcohol, but because those illegal actions are taking place on their property, they are primarily responsible. With that being said, we all know that he is fully aware of everything that was taking place on the campground property, but it seems a far fetch to not arrest him, yet take his land. If there are any future Schwag’s, then the Security Guards should fulfill their job descriptions and put a stop to drug use. I know that it will still continue to come through the gates but it’s better to try then to not make an attempt. Plus, think about the extra money the police department can make by arresting all of the people they find smoking in the woods. Win, win.

At least 30 people I have met over the course of 5 Schwag’s have been residents of Salem. Some of them have been recreational users, but most of them do not use at all. Each person has told me about the importance of Camp Zoe and how much money comes into the town because of the festivals it hosts. Due to of the size of Salem and the current economic downfall of the state of Missouri, I’m sure that the revenue they bring in as a result of Schwagstock attendees is of a high importance to them and probably plays a large role in being able to provide for themselves and their families on a regular basis.

Most of the people attending Schwagstock do smoke pot, but do not use any other drug. Prolonged usage of marijuana has very mild side affects which completely disappear mere months after quitting (this has been scientifically proven on numerous occasions so please don’t say it’s “stoner mumbo jumbo”). Who honestly knows how much personal damage is being done with hard drugs while at Schwagstock, but only one person has had to go to the hospital in the last few years, and not for drug related reasons. One is a really good number given that a thousand people show up to every event and its taking place in the woods. I do not condone the use of hard drugs (to me, anything but marijuana), but it seems like the festivals really are doing more good than harm. It boosts the communities’ economy and gives the attendees an outlet for their creativity, whether it is body painting, fire poi, playing an instrument, hula hooping, jewelry making, or dancing. Children under the age of 18 should not be allowed to attend, but that lies in the discretion of their parents.

On a side note….I never knew how sexy hula hooping could be. After my second Schwag, I had to buy one, and for the life of me, I can barely do it regularly! And the last time I attended, I cut my toe open on a rock and Safe Stock patched me right up. The staff and people attending Schwagstock have the biggest hearts and it would be a tragedy to take away something so precious to them.

I know I have written a book and no one will probably get this far, but to everyone that goes to Schwag in the unfortunate case that we never meet again,

To everyone upset about what seems to be the future closing of Camp Zoe, get over it. What can you expect when people are given absolute freedom to do what they want, they abuse it. I have been to the festivals, and not just schwag but several others, and i have seen this coming for years. When a festival like what Camp Zoe provides comes around, it opens the floodgates for drug dealers to peddle their goods and in a festival atmosphere it is simply an annex state. All bets are off, the small peddling of drugs escalates to a ridiculous number. Lets not forget that Camp Zoe holds SEVERAL festivals a year as well. To all you who hate teh govt for what they did....can you blame them....i mean when has any govt watched illegal activity take place, and just in a joint staff meeting, eh fuck it, just let them have their fun, no. The world doesnt work this way people, wake the hell up. The govt doesnt let people run wild and peddle drugs to their liking, because anyone who says this is a music festival is lieing through their teeth. We went to schwag twice, and we are incredibly sad to hear that we may never get to go again. Camp Zoe is beautiful and peaceful place with amazing people, all there to have a good time and enjoy music and the outdoors. We didn't have one bad experience and met some great friends, with so many people in one place I never seen a fight. I truly hope everything is sorted out, we couldn't imagine never getting to go again!. We will be at the benefit to support Camp Zoe in St. Louis on the 25th! LOOK IT UP!.

I have a tingles in my skin and all down my back! The last post Stacey Digges hit it right on the head! I have gone to swag and had the time of my life and it was "real". I have worked security for swag-stock and if you think you can get 8000+ people to 'not do' anything you are in need of pharmaceutical medication for mental problems!!! I think that moderation could have helped this from coming so soon, but wake up people the feds are loosing control and are mad as hell about it! Has anyone herd of the new conservation plan for that area? The state is making an elk preserve out of the hole area! And they will own all of it now!!!! I seen the plan last week but did not know about Zoe yet. I asked my wife" What are they gona do with swagstock if elk are running around?" Now I know!This is the part of the reason I moved to Alaska!!!In June I packed up my Family and drove to Alaska and we are staying forever!Alaska constitutional laws are set up to protect peoples rights! Not to take them! Thats right folks, Alaska State Constitution is newer and more people friendly. Alaska law protects the personal use of marijuana under 28 grams in your home, 18 and older! You can not sell it or transport it at all. Growing it is in the gray area without a medical card. But everyone that wants to grows! Thats rite you commy. federal bastards! We grow Marijuana and you can't stop us!!!! As for the rest of the drugs out there...You all can keep them. You were my first festival experience at the tender age of 18. Been 7 years ago now. It was a different Shwag at that time. Alot mellower. More love and care for the campgrounds then the end...it was magic.

As I walked down the magnificent river edge, past the bluff, over a hill....saw a hippie boy sitting in a lawn chair in the water, with a bonfire built up in the middle of it. It was beautiful. I met I beautiful Australia boy, that I made conversation with all nite (alot just to keep him talking, what an accent!). He showed me around> I remember walking up on the show that night. The lights. The costumes. My heart flutters remembering. I felt like I had entered into a new reality. A beautiful reality. Took long walks under the full moon and endless ammounts of stars. Found connection with myself, others and the planet. I felt something I hadn't know I'd been searching for, but had needed for a long time.Knowing I wasn't alone in this big world. That humanity was in us and all around us. That a gathering of people could LOVE each other, without even knowing your name.

And that might sound like 'hippie drivel' to some, but I had those experiences and it gave me hope. Zoe was the first to show that to me.Since those times, those years ago, Zoe became about things other than the music and the love. It became corrupted and I distanced myself from her.

I hope to be able to walk her beaches again. To make rock dams and skip rocks in her waters. I hope they don't auction the property off to some rich yuppies that want to build their luxury three story mansion, with views overlooking the bluff. I hope the people will still get to be a part of this place, whether it houses the shwagstock parties or not.

Best of luck to Jimmy. It was inevitable...but the seizure is most unfortunate. Remember the good times.Learn from the bad.If there is a future spot like Zoe was for us, lets do our best not to corrupt it. These places are sanctuaries, and should be treated as such.

Maybe its just me but everyone i've met at any festival has seemed to genuinely care about my well being and the well being of others, even though most of these people were on drugs. Stop stereotyping people who believe in the hippie culture with thugs and criminals. The reason they use drugs is to get away from the shitty world the government and other greedy assholes create. I understand the government trying to clean it up but seizing it and shutting down music festivals is no way of doing that. I do not know what gives you the authority to speak for Mr. Garcia, but maybe you should read this:

I attended my first Schwagstock as a freshman in college with no idea of who the Grateful Dead was. Years later it is safe to say that I'm an outrageously huge deadhead, with credit due to the Schwag for exposing me to their music. The Schwag isn't "ripping off" their music, they are keeping the music alive so people can either relive their past experiences with it, or (for those like me who weren't able to see the Dead firsthand) can catch a tiny glimpse of the experience.

Come back down to earth and stop being so judgmental!

This is SO FUCKING RETARDED! Does anyone REALLY think it's possible to have a festival with hundreds of people and NOT have drug sales or usage? I am seventeen, and I only found out about ZOE right before schwagstock 45 and so I have only attended two festivals thus far. Camp Zoe is such a magical place, and it's the only thing I really look forward to. If I never get to go to another schwag again, I don't even know what I'll do. This is such CRAPPPP!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Schwagstock was the one place for me to go and listen to great music! it was a very small festival (as apposed to others) and it was something special for St. Louis and Salem and all the music lovers inbetween. That is why people are talking about as family, because to many that place is their second home. it was a place where you didnt have to worry about anything.. acuna matata.. it was paradise

but all great things come to an end :(

schwag suprisingly stayed around for a long time.. what happends to most small festies such as schagg is the police come in and shut it down. then new ones open up.

illegal things do go down there and they will continue to.i just hope that someone else can buy the property and keep it going.. what made schwag so special was its GORGEOUSE property. cliffs, caves, and current river made the BEST camp site!!

the police may shut it down, but the schwag band will find somewhere new to play at for all of their dedicated fans

I'm terribly sad that I cannot even smoke pot in the woods while listening to great music with great people anymore...christ...if your gonna seize Camp Zoe Uncle Sam....then you better shut down the sites of all concerts these days....kill the music why dont you!

I miss my phamily...I dream about Echo bluff every single night...anyone who hasnt been to Zoe doesn't understand the beauty of this place. My family and I go camping at Zoe all the time on non festival weekends...what the government is doing is just wrong. Jimmy did try to get help with the drugs but everyone just kept bringing them in and the cops REFUSED to help him get them out of the festivals! The pot smoking was one thing but when you have twelve year olds running around selling LSD and Mushrooms...something is wrong! Jimmy knew that just like everyone else did that is why he asked for the governments help but instead of them helping they take his land??????? WTF?

I have been to numerous outdoor music fests with drugs flowing freely woodstock/bonaroo,etc I have talked with police officers that told me they were to look the other way on drugs and only keep peace if there were fights. I was disgusted when I heard about camp zoe bust, our country needs to worry about more serious problems and not about drugs at a music festival. The real crime is law enforcement trying to steal someones land
