Earl Francis Ealey is charged with second-degree murder. And, yes, that's an enormous tracheotomy.
Updated 3:50 p.m. with name of victim.

Prosecutors have charged 64-year-old Earl Francis Ealey of Pevely with second-degree murder following an argument last night between the victim and the victim's estranged wife.

The Jefferson County Sheriff's Department reports that it was called at 11 p.m. Sunday to a home in the 1800 block of State Route Z in Pevely, where officers discovered a 36-year-old white male victim lying in the driveway with a gunshot wound to the upper torso. The victim was transported by ambulance to an area hospital and pronounced deceased.

According to the sheriff's department, the victim, Donald Horrell, and his wife filed separation papers last week. Yesterday the victim was to return his estranged wife's vehicle to a neutral location.

Instead, the victim discovered his estranged wife's whereabouts and confronted her. A verbal argument ensued, and the victim was asked to leave.

The victim then returned a short time later and an apparent argument ensued between the victim and several others, including his estranged wife. The argument escalated, resulting in the shooting of the victim.

Ealey is charged with second-degree murder and armed-criminal action. He's being held on a $250,000 cash-only bond.

Has there been any updates on this case...I haven't seen any more articles. I don't know Earl but I knew his brother James...now he's a man that should have spent most of his life in prison

My opinion is that my Fathers trach should have never even been discussed by anyone. Yes, I said father! He is a good person and I would like to thank everyone that supports and loves him. I miss my Dad and everyone that knows him knows why. And for those of you who want to judge him....SUCK IT

It's often best to get ALL the facts before passing judgement or making assumptions. There are 2 sides to every story. Frankie (Earl) is a great person. So was Donnie and both are dearly missed. My heart goes out to both families for their loss. I wish this tragedy could have been avoided. I understand it's human nature to form opinions and pass judgement. I just wish we'd all learn to get the facts before doing so.

this is ridiculous-no one has a right disabled or not to take anothers life-this man had children and one that he was raisinging by himself who now has no parent to be there for her when she goes to prom or gets married- theres a thing called 911...and obviously his wife is a big part of this as well. theres no excuse for murder.... if he looks crazy or a well dressed citizen-no execuses!!!!

Well Sence it don't look like any one that has committed realty knows Donny he was a real good friend of mine and the news only is showing half the story and Donny and Amy were getting along fine right before he they stopped over there .she had told Donny and his friend that was drive to go ahead and leave she would be fine just pick her up latter but five minutes after they left she called and told Donny that she wanted a devorse and the part that is realty messed up is she was happy as hell before they went there she was singing and laughing but I know that every ones saying that Earl isn't a bad guy but Donny was just trying to get his wife away from the envirment that she as is in over there. Donny didn't deserve that he was the greatest people that I have ever met they say if u only get one true friend in your life you are the richest person in the world we all miss you Donny we wont forget you love you bro

Well first off you should not comment on thinks you do not know. Earl received the hole in his neck as a result of the agent orange he encounter in Vietnam while serving his country. Earl is a good man and I have no doubt he was trying to protect the lady. If there is fault to be laid it should be on the Pevely PD who removed the victim earlier in enforcement of a restraining order and then let he go so he could go right back. My thought is he should've heeded the warning shots!

Earl is a good guy..I am sure he was protecting and it was self defense..He is one of the sweetest people I know.. And he always has a clean appearance. My heart goes out to both families. But people need not judge if they don't know all the facts.

Earl is probably one of the sweetest men I know! He, under normal circumstances would NEVER hurt a fly. Like someone already stated, aside from his trach which was a tragic result from Vietnam, he is extremely disabled, and would in NO WAY be able to defend himself against your average, healthy, 36 y/o man. I think its pathetic the way 85% of your American people are so quick to judge on a person's looks. I'd like to see what most of you look like out from behind that computer. Grow up and leave it to the courts to judge. Both families are suffering, no need to add insult to injury.

Frank ("Earl") is a very good hearted and caring person, the only reason he would ever do this thing , is to protect someone else. I don't believe. he would even go this far if it was just his in danger. And as far as his looks go...Well under normal conditions, He is usually very well groomed..

To all the people who think you are innocent until proven guilty, you are sadly mistaken. In this country you are guilty until proven innocent. It is a sad day when they take a disabled war vet and charge him with murder for defending himself. I know this man personally and he would not do this unless he didn't have any other choice which is self-defense.

Earl is a war vet that has been through hell and back. He and Donnie were apparently friends and never wanted to hurt him. Apparently Donnie got into an argument with most everyone at the house. Earl was apparently the one that got charged at and things got out of hand. Earl is severely disabled (the trach is only a small part of his problems) and having a healthy 36 yr old coming at him....I'm sure he panicked and is truly devastated by this tragedy. Both families are suffering.

I think, that Men, in History have always supported his fellow Man. It is belittling for the Press or a blogger, or the man on the street to add insult to injury. If a man doesn't look like your average 9 to 5 stiff collar, and a loud tie, that doesn't give anybody the right to put him down, for his looks. If this man is guilty of a crime, just report the facts, and leave the looks to God. His trach, though, as difficult it may be to see, is his trach, and he has to live with it. Leave the man's appearance to him, for he is a Man. Leave this man's crime, to the court's to Judge, for he is innocent until proven guilty. Who are you, ask yourself, to bring out one's faults? Would you like yours made public?

If you do not know him you should not comment or judge. Of course they put up the worst photo they took of him. Let's wait and see what comes of this. Earl was most likely protecting this woman or himself. It had to take the ultimate to bring this out of him if he did it. Do you not see how scared he looks. He's a good guy.

I would argue self defense...obviously this guy was shot first.

I agree. What does that have to do with any damn thing? Gotta consider the source sometimes. People are cruel and just plain stupid.

Great that Donnie had you as a friend, no doubt, but you don't have the all facts either.  He was not trying to get Amy out of "that environment". I know because that terrible environment was my house. Donnie was a good friend and Frankie and Amy were there to go thru garage sale stuff. Today would be Donnie's birthday. He's very missed and so is Frankie.

Earl is a very close family friend of mine and I call him a relative. He has done no wrong in my eyes. Get into it with someone half your age that has twice the capabilities you do because you're handicapped. SELF DEFENSE. I would expect an old man to shoot me too if I came at him!

Boomersmomma08

I think a call to 911 was more in order than MURDER..... Donnie was shot OUTSIDE the home.... Stay in the house and call the police ..... don't take the law into your own hands...... Look how many lives are ruined now..... Donnie's family, and Earl's too..... there had to be a better solution for all involved.....
