Jimmy Tebeau's Lawyer Vows "Vigorous Defense"

Jimmy Tebeau is being charged under a statute normally used to target crack houses, his lawyer says.
We touched base this morning with Scott Rosenblum, widely thought to be one of the best criminal defense lawyers in St. Louis -- and, not so coincidentally, the guy representing Jimmy Tebeau.

Tebeau, 44, was indicted by a grand jury last week on one felony count of "maintaining a drug-involved premises."

That charge came seven months after the United States government first filed paperwork to seize Tebeau's 350-acre property in rural Missouri, Camp Zoe. Camp Zoe's home to the popular Schwagstock music festivals -- but the feds allege that "Tebeau consciously managed the concerts and campground for the specific purpose of facilitating the distribution and use of multiple controlled substances by the concert patrons." If they can prove that, it could be enough to allow them to seize the property under a process called "asset forfeiture."

But, as Rosenblum vowed in a phone call this morning, Tebeau is not giving up without a fight: "We intend to enter a plea of not guilty and mount a vigorous defense."
As Rosenblum confirmed, the charge of "maintaining a drug-involved premises" is unusual. "It's not used often," he says -- and particularly not for a concert promoter/musician. "Historically, it was designed for use against crack houses."

As for the feds' claim that Camp Zoe was operated specifically for the purpose of drug sales and consumption, Rosenblum says, "I think there would be thousands and thousands of music fans who would disagree with that."

Rosenblum says he expects the criminal case to take precedence over the feds' seizure attempts. The government is also trying to take at least $250,000 in cash from Tebeau, saying that they should get a share of Camp Zoe's gate receipts because of the rampant drug use on the property.

I think the feds should look at the promoters of the events held at Camp Zoe.  I saw a lot of crazy stuff going down at the Underground Sounds too.

Jimmy Tebeau is a criminal...PERIOD. I am a mother that has been in there to get my teen daughter out of there. What I saw in there I will never forget... It was sickening!!!! I hope that he serves a 20 year sentence. He is not the innocent victim some of you like to believe he is. It is a business. He made a lot of money. He could have cared less what was going on in there as long as he had his money. Given the opportunity, I would love to testify against him in court. It would make my day!!!

I found needles on the ground and they weren't fro diabetics looking to get up on their insulin. I found a dude at the guys bathroom with a young lady who was there the entire night offering some sort of service to the guys as they went in. I found a dude laughing his ass off as he shit in the middle of the bathroom floor when the toilet stopped working.I went looking for a new experience. I found way more than I wanted.If you look for light, love, and happiness in this world you can find it in just about anything. The human brain is extremely powerful. That's not what I saw, and that's not what the Feds saw. They saw an opportunity to cash in. Save up and go to Wakarusa or burning man. These festivals are quality. Zoe did not represent Missouri well.

Knowing Jimmy as I do, he certainly did not buy Zoe to facilitate drug sales on any level...Before Zoe there we many campgrounds operated by individuals, families and organizations hosting Schwagstocks. This is a money grab attempt by some anal feds...Can someone direct me to any of the drug deal perps that are all working for Jimmy?

Excuse me?  I don't know where you were at Zoe that you saw such things, but that was never my experience.  Were you seeking out those drugs and happened to find someone who had them?  I saw Nitrous chased off the grounds many times.  Never did I hear anyone offer heroin (assuming that's what you were referring to with Heron).  Saw one kid offering Meth immediately get chased off the property.  Sexual assault?  If you want to call a girl being so stupid as to get shit faced and then waking up next to a stranger an assault, then maybe.  If you go anywhere looking for negative drugs and negative people, you can find them.  If you go looking for joy, music, laughter, good people, then that is what you will find.  It's what I found at Zoe.

Music Festivals are awesome.  But this one DID have a lot of self governing going on.  And those who held it down were the dealers who claimed territory over certain sections.  Not the promoters.  They didnt try to control it. 

 One man did, and for him it was unfortunately a lost cause.  And I'm not talking about Jimmy.  Stop denying it people.  Weed is one thing, but used needles on the ground where kids run barefoot?  I know im not the only one who saw this shit.  Cocaine, Meth, Acid, Gas, Heron.  What do you want?  Schwagstock had it.  Sexual Assualt, Underage drinking.  It was all there.

  Dont confuse the love of great music with the reality of this poorly run and unstable listening environment. Been there, did that, and shits was crazy.  Lets move on and grow from the experience,  We can do better.

Crazy!!! Someone should file a complaint against the US Attorney for the wanton waste of tax dollars for allowing if not instigating this farce. How would you do this he is appointed by the president and approved by congress...we can impeach a president... how do you get rid of an incompetent BOOB like Richard Callahan. That kind of national act cost lots of money to book. Also if  Jimmy Tebeau was on stage playing music how could he be dealing with the crowd. Maybe he shoudl ahve hired more security but I dont think he booked the entire festival JUST to sell drugs.

The U City police "can't stop" open pot smoking outside certain venues in the Loop either. It seems unreasonable to call Jimmy a felon because he can't stop pot smoking on his 300 acres filled with 7,000 guests.

Has smoked in front of the oyster bar many many many times, has shared with groups of people many many times in front of the oyster bar and other establishments. Does that make the person who owns the oyster bar in the same position as jimmy? I mean shit, if hes at fault here for that cause then the people who owned the land wood stock was on should be held to the same damn degree, and the amphitheater, I've been there and smelled pot in the air, followed and found. Shit I've found it at an ozzfest, shouldn't ozzy go to jail or be brought up on these charges... What about snoop dog, you know its not just a fuckin front he puts on.

The distinction the Feds will make is that they claim that Jimmy wantonly and knowingly allowed not only the use but the sale of illegal drugs. They demonstrate repeated incidents of this to convince the court/jury that this is in fact what happened. 

I doubt they can really 'prove' this crime because to do so they have to show intent, which they would have to have Jimmy's words to back that up. On top of that I don't agree with the law here, especially the forfeiture part. Additionally, as you pointed out, I think the Fox and other venues knowing turn a blind eye to the 'USE' of these illegal drugs as well - even if it is not on the same level, it is still just as illegal under these laws - yet they will never be prosecuted. If I am honest with myself, he probably was letting this go on - but I would never convict.
