Lawsuit Against Mandatory Drug Tests at Linn State Gets Class-Action Status

An update to that story we told you about earlier this fall when Linn State Technical College in rural Missouri announced it would drug test all new students entering the school.

In September the ACLU of Eastern Missouri sued the institution arguing that suspicionless drug testing violated the Fourth Amendment that prohibits unlawful search and seizure. Last week the ACLU won a preliminary injunction that bars the school from administering drug tests until the lawsuit is adjudicated. The ACLU was also granted class certification last week to represent any and all students in defending their Fourth Amendment rights.
