David Evans, Legislative Aide Who Left Loaded Gun in Capitol Bathroom, Resigns

Although House Speaker Tim Jones made it clear there would be no discipline for a legislative aide who left a loaded handgun in a men's restroom at the state's capitol building, Jones' spokesman Tom Smith now confirms that the aide has resigned.

"I officially accepted the resignation of staff member Dave Evans on Friday, September 27," writes Smith in a statement sent to Daily RFT.

That means Evans resigned exactly one week after a custodian discovered his 9 mm pistol on top of a toilet paper dispenser in a basement bathroom at the Missouri State Capitol in Jefferson City.

Here's the full statement from Smith:

I officially accepted the resignation of staff member Dave Evans on Friday, September 27. While I was satisfied with the corrective actions Dave agreed to take to make amends for his mistake, he ultimately felt it was in the best interests of his colleagues and friends in the Capitol, as well as for himself and his family, to move on to another endeavor. The office will sorely miss his strong work ethic and high level of professionalism, but we wish him the best of luck as he moves on to what I am sure will be a successful next step in his professional career.

We left a message on Evans' phone and will update if we hear more.

Evans left his loaded Kahr CM9 9 mm pistol still in its holster and did not realize his mistake until about an hour later. By then it was already in the possession of the Missouri Capitol Police. Evans had a valid conceal-and-carry license, and he was allowed to take the weapon back. Police say the gun was fully loaded with hollow point bullets. Read our original coverage here.
