Report: CZR0026 46TH JUDICIAL CIRCUIT

CIRCUIT COURT DOCKET SHEET

12L6-CR00665-02 ST V XIU HUI JIANG

Security Level: 3 Confidential

Filing Date: 18·Nov-20 13

Description

Dismiss by Ct w/o Prejudice

Upon Defendant's Renewed Motion to Dismiss Count I, the Court heard argument from Defendant's

Counsel that was not refuted by the Prosecuting Attorney, due to new information obtained after the

Office of the Prosecuting Attorney was able to interview the alleged victim upon said person turning 18

years of age The new information available to the State shows that the allegations made, if taken in

light most favorable to the State or if proven at trial would not establish that Defendant was ever alone

with the alleged victim but rather the alleged victims parents and siblings were at all times present

during any alleged occurrence, if any occured. Further, Defendant was neither the alleged victim's

confessor nor her confirmation sponsor, nor was he at anytime otherwise charged with the care and

custody of such person as was originally alleged by the State. Other factors and more specific details

need not be stated herein out of respect for all persons involed. Defendant filed his original Motion to

Dismiss PRIOR TO the full investigation in this case, which could only conclude once the alleged

victim was at least 18 years of age. The facts now known to the State which have been relayed to the

Court during argument on this Motion make it clear that this Count is improper as a matter of law. The

Court points out that the Honorable Judge Dan Dildine and the State of Missouri through the

Prosecuting Attorney did not have all the information now available when this charge was originally

filed, prior arguments were rnade, memorandums were filed, and when said Judge has previously

denied this Motion to Dismiss. The Court hereby dismisses Count I herein.

Dismissed

Dismissal as to Count IL

Just because charges are dropped doesn't mean a person is innocent it simply means they couldn't bring the case at this time and in this case that's because the prosecutor did not do her job. She was not familiar with the case, only learned certain facts the last time she went to court because she had been unprepared and failed to read the case file and do her research. The fault here lies with the Lincoln County law enforcement and judicial system. There is a lot of proof (more than what has been released) about what happened and eventually it will be known. Those who defend Jiang will feel bad for their attacks on a young girl and her family when they learn the truth. You should pray you are never in their shoes and given the treatment you have given them.

Way too many unanswered questions here.  The guy obviously did something bad enough that he delivered a $20,000 check to them.  I'm guessing it got dismissed because they can't prove that he had intercourse with her.  And maybe he didn't, yet.  But did he buy her a Coach purse?  Did he ask her to look more like a woman for him?  Did he go to their house crying?  Did someone see him fondling her in the church parking lot?  Did he hear her confession alone in her bedroom?

Whether it meets the criminal statute or not, this guy sounds psychotic and certainly pedophilic.

It's not Father Joseph Jiangs fault.

Jesus guided his hands and made that child irresistibly cute. Then the power of His church Archdiocese exorcised their infallibility in hushing it up.

Praise! The Lord works in mysterious ways that we "un-initiated" can not understand. It is all part of the His Holy scheme of divinity, and the rewards given to those who have power granted by the invisible Divine Trilogy.

{Translation: In the eyes of the Lord it is Ok to sexualy screw around with a child, just don't get caught and embarrass the Bishop.}

Archbishop Carlson's tactic to get these allegations dismissed is very cruel for the victim and her family. But his tactic did not work, he now has more allegations against him.
It is pretty clear that Carlson does not want the truth to be exposed. Could he land himself behind bars along with Fr Jiang?

Something to keep in mind-
Child predators are very cunning and manipulative. They know every trick on how
to groom, threaten, lie, and put the fear of god into their victims and
sometimes even their family members.
They also appear to do a lot of goods things, they can be very charismatic and
you may think they would never harm a child. They have to be this way, in order
to not get caught and to continue to abuse

Sexual predators are often powerful and well-loved. It would be comforting if
those who preyed on the vulnerable were obvious social misfits whose appearance
would somehow set off alarm bells and give us the willies or the creeps. They
rarely do. Usually, predators are among the last people we would suspect of
sexually violating others.  While they are grooming the child and even family members, they
devote lots of time and energy building trust with them by giving them money and gifts.
They tend to make the child feel that they are special and loved.

It takes a lot of courage to come forward and take action about being sexually abused. This is not an easy thing to do, but it is extremely rare that a child predator has only one victim. Some have many. So let's hope that anyone who may have knowledge or may have been harmed by Fr Jiang, will get help and find the courage and strength to speak up and contact law enforcement, no matter how long ago it happened.

Silence only hurts, and by speaking up there is a chance for healing, exposing the truth, and therefore protecting others.
The only way to get these child sex crimes and coverups stopped is to allow victims to have their day in court, Until this happens and all are held accountable, nothing will change and children are still not safe within this institution.

Since 2002, the Catholic faithful here in America have witnessed time and again, the duplicity, insincerity, hypocrisy and untruthful conduct, behavior and decision-making of many of the religious leaders of the dioceses and archdioceses across this country. Over the past several months, Bishop Myers as well as Archbishop Nienstedt in Minneapolis-St. Paul have been shown, via statements, evidence, correspondence, etc., to be unable and unwilling to protect the children and young adults of the Catholic faithful in their charge. Along with Bishop Finn in Kansas City, it is well past the time that any further consideration be given these "leaders" and push for the tough and necessary legislative proposals that will help to protect ALL children, now and in the future.

Retiring from the field of law enforcement here in Philadelphia, there is nothing better to capture the attention of criminals (in this case, alleged child sexual abusers and conspirators/abettors) than the cold steel of handcuffs, fingerprint ink on the extremities, the spartan and unexciting cuisine of detention centers, and the appropriate fashion statement of the orange wardrobe.

The criminal case no longer exists on Case.net.  The charges have always been questionable.  I now have to wonder if, perhaps, they have been dropped altogether after the prosecutor backed away from trial on 4 occasions.

The ties between Carlson and Jiang are close and unusual. In 1983, Carlson was appointed auxiliary bishop of St. Paul and Minneapolis, where Jiang attended seminary. In 2004, Carlson was promoted to Saginaw’s bishop and brought Jiang with him. In 2009, Carlson was promoted to St. Louis’ archbishop and again brought Jiang with him. In May 2010 at the Cathedral, Carlson ordained Fr. Jiang a priest. (Before that, Jiang was a deacon at the Cathedral.) According to the suit, “Fr. Jiang lived in (Carlson’s) private residence in St. Louis and maintained a bedroom a few doors down from (Carlson’s).”

Carlson has some explaining to do.

@averyconcernedmom Gee, "averyconcernedmom," why don't you share some of this so-called "information" that "has not been released"?

You obviously do not know that prosecutors drop cases for only *one* reason: They can't win.

This case was bogus. Period.

Have you considered that the so-called "evidence" never even existed in the first place?

@slkleman Have you considered that the episode about the $20,000 check never even happened?

Prosecutors drop cases for only one reason: They can't win.

Read: This case is bogus.

@luvieski Michael, charges were dropped against Fr. Joseph Jiang.  He's innocent.  No need to continue pursuing guilt where it doesn't exist.

@snapclohessy Archbishop Carlson has to "explain" that he has known other priests?? What the ---??

Did you even *think* about you were saying before you wrote what you did?

Good grief, David. You are losing it more and more every day.

@snapclohessy David, give it up.  It now appears as if this case has disappeared.  The prosecution backed away from trial FOUR times, despite the defense's willingness to have a fair and speedy trial.   Connections between Fr. Jiang and Archbishop Carlson are meaningless if abuse never occurred!

@baker22 @luvieski

My comments were not directed specifically at Fr. Jiang's case.  The comments were a reminder of the facts, evidence, correspondence, statements, etc. that are in the public arena that clearly demonstrate the duplicitous and disingenuous conduct of some of our US Catholic Church leaders when it relates to the protection of our children and/or accountability for actions and conduct for criminal sexual abuse that has already occurred by some of the clergy.

@baker22 -- this is a civil lawsuit, does prosecution go with criminal or civil actions in St. Louis?  Learn the difference before stepping up to the toilet

@baker22 @skibrs I wonder how squeaky the floors are between the two bedrooms? Let's go on a late night tour of the building

@skibrs @baker22 Please.  The two are obviously related.  What is Carlson supposed to explain?  He's friends with a priest?  You know I happen to be friends with some of my co-workers too.  Having friends is a terrible crime these days, I suppose.
