Without State of Emergency in Ferguson, Nixon Can't Change Michael Brown Prosecutor

The Don't Shoot Coalition, a new alliance of St. Louis organizations and leaders, demanded that Governor Jay Nixon replace Prosecuting Attorney Bob McCulloch with a special prosecutor this week to restore public confidence in the trial over Michael Brown's death.

But an hour before the group was to make their demands public at a Clayton press conference, Nixon lifted the state of emergency he declared August 16, effectively ending his ability to appoint a new prosecutor.

"Over the past week, we've seen students getting back to school, businesses reopening their doors and folks getting back to their normal routines," Nixon said in a statement. "This progress is a testament to the efforts of community and faith leaders, working alongside state and local law enforcement officers, to bring peace to the streets of Ferguson and much-needed stability to its citizens."

Nixon's declaration throws a curve ball to demonstrators who wanted him to remove McCulloch from the case, including some who were planning on blocking highway traffic next week to protest for a special prosecutor. McCulloch has said he has no intention of stepping down, and without a state of emergency, the governor can't force him off the case.

"What they're doing is playing ping pong on the back of a dead man," State Senator Jamilah Nasheed, a member of the coalition, tells St. Louis Public Radio.

The coalition sent a letter to Nixon Tuesday denouncing the "sloppiness, irregularity and unprofessional behavior" from officials after Brown's death, including leaving Brown's body on the street for hours, withholding of details from the shooting and using force against peaceful demonstrators. Without a special prosecutor, "peace and healing will be elusive," the letter says.

"The appointment of a special prosecutor is key to the public's confidence in future proceedings of this case," says Montague Simmons of the Organization for Black Struggle, one of the leaders of the Don't Shoot Coalition. "We have witnessed unacceptable behavior from all levels of government in St. Louis County, and it has resulted in the loss of public confidence in law enforcement and existing systems of oversight."

The coalition was careful not to malign McCulloch, who has been critical of the governor's seeming indecision over whether to remove him from the case. The letter to Nixon says McCulloch shouldn't take the call to replace him on Brown's case as a "personal affront."

"Only [McCulloch's] recusal can demonstrate his concern for the needs of the community and willingness to open the matter for the process that has the greatest integrity," the letter says. "Failure to recuse himself from this case will show the opposite."

Here are the long- and short-term goals from the Don't Shoot Coalition:


1. A Special Prosecutor to conduct a transparent and independent investigation into Michael Brown's death, and an expanded Department of Justice investigation into patterns of civil rights violations across North County.

2. An end to ongoing racial profiling across North County as documented by annual Missouri statistics.

3. Accountability for police practices and policies, including effective civilian review regarding shootings and allegations of police misconduct.

4. Ongoing initiatives to ensure that local law enforcement departments represent the communities they serve.

The new list of demands is a condensed version of the local and national demands the coalition and its partners made last month:

Local goals: 1. Swift and impartial investigation by the Department of Justice into the Michael Brown shooting

2. Immediate arrest of Officer Darren Wilson

3. County Prosecutor Robert McCullough to stand down and allow a Special Prosecutor to be appointed

4. Firing of Ferguson Police Chief Thomas Jackson

5. Immediate de-escalation of militarized policing of peaceful protesters

6. Ensure the protection of the rights of people to assemble and peacefully protest

7. Hold law enforcement officers accountable for excessive use of force on peaceful protests

8. Immediate release of individuals who have participated in their right to assemble and peacefully protest

National goals:
1. Obama to come to Ferguson to meet with the people whose human rights have been violated by aggressive and militarized policing, including the family of the victim-Michael Brown

2. Eric Holder to use the full resources and power of the Department of Justice to implement a nationwide investigation of systemic police brutality and harassment in black and brown communities

3. Ensure transparency, accountability, and safety of our communities by requiring front facing cameras in police departments with records of racial disparities in stops, arrests, killings, and excessive force complaints

4. Immediate suspension without pay of law enforcement officers that have used or approved excessive use of force. Additionally, their personal information and policing history should be made available to the public

First of all Mike Brown didn't have common run in with the law. He didn't even rob the store he was accused of. There's video evidence. Secondly if murderers deserve a fair trial and the police properly arrest them why should a petty theft justify a murder you ignorant sack of shit? People like you just don't use their head. Its proven that black people are arrested for drugs at larger rates although white people and black people do drugs at the same rate. Its also a proven fact that blacks typically do more time for the same crimes that white people commit. I'm not black so I'm not benefitting from me saying all this... Its just the truth and the truth needs to be told. Republicans are known for denying cold hard facts... According to you guys... Cindi Douglas- Asher who's coming out with these so called facts then? The prosecutors and everyone else involved in this case wasn't there either. The only people who were there were the witnesses, of which none of them took up for the cop. Its important to know that the witness with Mike was the only one with a previous relationship with Mike. Another witness just met Mike minutes before the shooting so had no real connection to him. All other witnesses defended Mike Brown but didn't even know him at all. They were all from different perspectives too. So the only people who actually were there defended Mike. The cop is the only one who says otherwise.

I don't think she is trying to separate anyone. Only explain. I saw Jamilah's interview on CNN and on FoxNews, and in both interviews she kept referring to "the blacks". ("the black vote", the black people", the black protesters") So Jamilah Nasheed can do it, but Shannon cannot? Relax Jacob, she is simply using the same language that Jamilah used to make a point. I don't think it was intended the way you assumed.

And what if then the white community doesn't trust that person? That's why we have elections for these positions!!!! Why is it any more difficult for blacks to vote than for whites? If you tell me it has to do with socio-economic status that is not a racial issue, it is an economic one. Voting is no different than going to work in the morning. Just need to carve out 30 minutes. I'm sure most of the 80%+ that didn't vote in Furguson were not so busy that they couldn't make it to the polling place considering the average work week is less than 40 hours and unemploment is higher than 15%.

Oh yes, how horrible, she's standing with her constituents on an important issue.  I am just glad some actual elected officials are talking to people that aren't necessarily voting for or did vote for her, and not just talking to us during  a campaign. 
True, she represents the city, which is 49.5 percent black, but the problem with Klan cops running amok, terrorizing black communities needs to be addressed in all communities.  And McCulloch has been in office 23 years!  Funny he backed Steve Stenger, whose entire campaign was based around Dooley being in office for 10 years and "time for change". HAHA

Write in Michael Brown on the ballot and vote for him this November, just to send a message.

And the media is not "stirring up shit" they are reporting what is happening.  I didn't see any opinions of the RFT expressed, just coverage of a major issue.  If you don't like it, go back to Fox News.

@Tyrone Ah yes, those racist black people, enslaving and segregating white people, raping white women to increase their slaveholdings, lynching white men.  Funny you should say that about the Black Panthers, that is exactly why the started and all this hoopla you hear about the 2nd Amendment and the right to bear arms comes from the Panthers.  I am white and live in North County, and the Panthers or NOI are welcome to take the job as far as I am concerned.  Let's see what someone else can do.  And since McCulloch is running unopposed, I was going to write in John Lennon's name and vote for him (just to send a message, after 23 years- time for change) but now I think I will write in Dorian Johnson.  Thanks.

I don't think Jamilah is wrong. Black people have been enslaved, segregated, terrorized, treated as less than equal, etc.  Jamilah Nasheed talking about the struggles of her people is different than some stupid racist girl blathering off what she heard on Fox News.

Wow.  You really don't see the difference?  Shannon does not live in a world where black people are anything but "the other".  Jamilah is black and is talking about the ongoing struggle of her people for true equality in this country.  Jamilah and other black people are born that way, but someone like Shannon has to work real hard at being a racist idiot.

And btw, I think Good Ole White Boy Network in North county and all of St Louis city can look forward to being in the minority of voters in future elections.  Time for change.

Ferguson had a higher voter turnout in the last election than Missouri's overall turnout.  I think things are about to change.  In the city black people are 49.5 percent of the population.  Many counties like Ferguson are higher than that.  Will be real interesting to see the colour change in elected officials. As a reminder, to everyone, you can also vote absentee and mail your vote in. Very simple.  Just get registered by the last week in September.
And Mc Culloch is running unopposed, but if you don't like him, write in anyone's name and vote for your write in.  Just to send a nice message.  Not just to McCulloch, but to anyone that is thinking about running against him in the future.  His political career is pretty much over in St. Louis.

@Shannon_L There is a massive voter drive going on, but you probably haven't been reading about that.  St Louis city is 49.5 African American.  And Ferguson isn't the only part of North County that is mostly black. I hope everyone that can vote, does vote. Get some colour in our elected officials, and hopefully bring some real change.
  McCulloch's running unopposed, but to send a strong message, write in the name of anyone (I will be voting for dead Beatle John Lennon instead of McCulloch) to send a message.

Sorry, you are wrong.  Voting is not a requirement.  Those that don't vote allow those that do to choose for them, but the elected official is still responsible for everyone in his/her constituency.  I wish more people, especially elected officials, would remember that.  Funny how it takes a riot to get elected officials to come talk to people regardless of whether they are voters, and when the officials aren't on a campaign trail.
Also, McCulloch is running unopposed.  So even if someone takes my suggestion to write in the name of ANYONE, living or dead, and vote for him/her, we will still be stuck with McCulloch.  Lawyers with a strong sense of justice rarely end up as prosecutors.  Maybe that will change.
In the meantime, don't like McCulloch?  Write in John Lennon's name, or whomever, and vote for him.  That's what I am doing.  Will send a nice message, if nothing else.

Anyone that doesn't like McCulloch can write in the name of ANYONE on the ballot -- I'm going to write "John Lennon".  No Lennon won't replace McCulloch, but it would send a nice message if deceased write in candidates got more votes than "bubba" Bob.
