Elsinore's Proposed Album Cover Causes a Copyright Uproar

• From Elsinore's Facebook: "The Estate of Roy Lichtenstein has told us they are ok with us using our album cover. WE WIN!!!"

• No Jerryface the original source is the original source. That is why we have the word "original" which Lichtenstein just plain wasn't! I would refer anyone who thinks otherwise to the splendid comic geek history "Men Of Tomorrow" where it is made plain what a blatant thief Roy L was. Lichtenstein's entire argument was that he was "recontextualising" the images. Even if Pyle did find it via Lichtenstein then surely that is was "recontextualisation" as well? The Lichtenstein estate seem to want the penny and the bun. Hopefully the likes of Kirby and Irv Novik will get their due and Lichtenstein's rep will rightly wither and die.

• Stupid move on the band's part- You can't play around when you're dealing with one of the most iconic pieces of art from the 20th century... Unless being subversive was their intent, but it sure doesn't sound like it. Stupid move on the Pyle's part- Yeah, she may have been looking at the original when she made her painting, but the true source is still Lichtenstein, because THAT'S how she got to the original illustration in the first place, and no one would believe that she found the original comic book independently. Not only that, her teacher should've told her that when you're a student doing an assignment, you're exempt from a lot of copyright rules, but NOT if you publish the stuff... And finally, it has to be mentioned, how lame is the text in Pyle's piece? It's embarrassing. Good luck in court- guaranteed loss for Elsinore. This could be years and years of headaches, and in the end, financially ruin them.

• uhhh, i really don't care for the cover, so I hope that they change it, but whatever. Roy lickachin is a big dummy who copies paintings and then gets mad when others do the same. what a big dummy dumb head.

• First, it's from a romance comic book, not a "graphic novel". Second, Lichtenstein himself swiped the drawing so the estate's claim is beyond the most liberal interpretaton of copyright law.

• Quite obvious so to say. Maybe the Lichtenstein estate can figure out "a context" why this time it IS supposed to be a copyright infringement?! OMG

• Lichtenstein has no case. Look at the nose. It's taken directly from the original source, not Lichtenstein's painting! There are other details, too, that, if she was copying off of Lichtenstein's painting, would not be on the album cover!

• So, why isn't Pyle suing Roy Lichtenstein?

• chris - are you unaware of Roy Lichtenstein? his career is founded on redrawing comics. his is the gal with the blond hair. it seems pretty obvious that the artist who make the cover for the CD was copying the original source, not Roy Lichtenstein. his estate has not right to sue, and it seems antithetical to what Roy Lichtenstein said himself about how his works weren't copies because of context.

• You kidding me? That is a 100% recreation. It's merely in different colors. It's the exact same drawing. They *should* be sued for this.

• If any one knows how to contact them, I'll be glad to tell the Lichtenstein Estate to go jump off a cliff. But seriously, copyright claims are getting way out of hand in this country.

• Hey, even bad press is good press. This is probably the best thing to ever happen to indie band Elsinore. Yes, they have to hire a lawyer, and maybe even need to recall the albums or something, but they might even win the case. And anyway, the press is covering them the whole way, so keep on rocking!
