Local Singer of "Ferret in the Closet Act II" Takes On America's Got Talent

Today we bring you the latest news from Walt Winston, who was recently subjected to the America's Got Talent treatment. His friend was so incredibly pumped about this story we're about to share that he called RFT headquarters and freaked out over the phone. Thank you, friend of Walt's, for telling us about the latest travails of the local, charming and bespectacled singer-songwriter who earlier this month challenged traditional notions of both singing and songwriting with his bold entry on America's Got Talent. Those of you at home can begin by watching the clip below, in which he sings a creation of his called "Truck Drivers Aren't Supposed to Cry."

There are three aspects of Walt we're particularly fond of:

1. His lyrics are both autobiographical (he was once a truck driver) and genius. They're also kind of brave, if you think about it, and we get a kick out of a St. Louis native doing his somewhat strange thing on a national stage.

2. He looks like a member of The Beatles, though we have to put our foot down all over Howie Mandel's comparison to Ringo. He clearly looks a lot more like John. Added bonus: They're the dude's favorite band, which makes this that much more candy-coated.

3. He can tolerate Nick Cannon.

These things were all adorable and baffling enough before we found out the secret fourth addition to this list:

4. He has a YouTube channel. Said channel, which he maintains under the username walteria1964, includes both solo jams and the group work of Walt Winston and The Waltles, a name we cannot emphasize the brilliance of enough. As you click through his work, enjoy the highlights of a side of the local artist (and A to Z hero) that America proper did not get to see. We work at a St. Louis area radio station and listened to Walt Winston's single and the single Patrick is talking about by the Rolling Stones by the way, and we all agree Patrick is way off base and can get sued for trying to injure Walt's business and reputation, which is exactly what Patrick and even Robert is trying to do deliberately.   We heard the single and in our expert opinion, the single is indeed Walt Winston's and it's a damn good one.      Also after reading Walt's post, I would tend to agree with Walt wholeheartedly, as he brings up many valid and undisputed points.   Apparently Walt went through a very strict vetting process and we did our own research and we were stunned by many things we didn't know about the man and his music.   I also know that you won't hear the biggest singles in the initial rounds of the competition in which case, if Patrick is even close to right, the single wouldn't have been allowed to air, and Walt would have been disqualified, and the media would have been all over this so called controversy which there is none except in the mind of Patrick.   Our conclusion:  The single is Walt's and Walt's alone!   CASE CLOSED!

@radio-dj  Thank you for speaking the truth!  We are meeting with our attorneys who are ready to go forward with our suit against those who wish to smear me with outright lies and these people will learn the hard way that one don't state lies as facts and expect to get away with this.   This charge is very serious and these people will learn that there are consequences for their actions.

I'M  STILL STANDING!!   

   Patrick, in case you haven't noticed if your claim was true which we all know it isn't America's Got Talent would not have allowed me to use MY single!   In the process of performing any single on the program for the judges round AGT has to have a list of singles submitted by me to see if they would have clearance to perform them.   The covers that I used to perform when I played in gigs at clubs or anywhere I played they could not get clearance for. 

    Have you noticed that music published by ABCKO music is not performed in the first judges round??? That's because they don't grant permission for their works to be performed.   The same reason you don't hear any music written by The Beatles or any of their cover songs that they used to play because they can't get the clearance from those writers and publishers.   

    If you did your research, you will see that "Truck Drivers Aren't Supposed To Cry" is NOT an ABCKO song is it?    

   Look at the writing and publishing of the single.   It's not Marianne Faithful or ABCKO is it?  

It's published by Wally Goat Music owned by me.   AGT had to get permission from my publisher to use the single because of the royalties that AGT and programs like AGT pay to use.      Simply put if I didn't write it I would not have been allowed to perform it on a program like AGT.

    You've stated this false claim on at least 3 different websites and they've proven you wrong big time.     If your claim was true at all TMZ would have been all over it and guess what they haven't!   
   If anyone is going to freak out you would for putting someone through frivolous lawsuit after frivolous lawsuit and you would have to pay my legal fees I guarantee that.   

   Something you also don't know is that I know quite a lot about law as I used to cover court cases as a news reporter and being a member of the broadcast media like I was I know all about the writing and publishing laws and I've always played by the rules and you don't like it because I'M STILL STANDING!

ACCOUNT SUSPENDED is going to be walts new tune once all the facts are presented to the right people

ABCKO MUSIC may have some ideas on walts creative use of their melody,maybe he could actually pay the fee for use of this melody but i hope he freaks out and attempts to sue them so he can reap the joy of paying the legal fees that would cripple a real artist let alone a pretend one like walt

i wonder if facebook or youtube is aware of this POSSIBLE  ALLEGEDmisuse/abuse/theft of this melody
there is also a 4 note riff walt over uses that i know he lifted of another song but have yet to pib it down so walt gets those notes for free for now...,i will not go in to the very detailed deconstruction of the horrible recording of this song but lets say walt used certain effects to cover his POSSIBLE ALLEGED theft and his certified 100% factual lack of recording and guitar tuning and playing skilll(his musical talent is right next to nil,dryer lint is what i think of when i think walt winston)

please do not copy and paste your usual responses walt,they are obvious and stale,come up with some new fun delusions and fictioanl stories veiled with hollow limp threats frosted with your ORIGINALwet diaper cry baby-ism...

@patrickcooksey   FOUND GUILTY OF VIOLATING THE DMCA or Digital Millennium Copyright Act would be Patrick Cooksey's tune, as patrick you would be guilty under  17 USC 512 (f)  which is 'Fraudulent takedown of material that is rightfully owned is ILLEGAL under that statute and is prosecuted for both damages and perjury.   I'm no lawyer but after checking out all of the facts here, and reading about OPG  v Diebold which could turn out Winston v Cooksey and others who want to play this stupid game that you're playing.     

   Do you honestly think Winston took a song from the Rolling Stones?   It don't sound like that to me.   What are you trying to do here?   

   Make no mistake about it here patrick this man has done nothing wrong and if anything, you're getting yourself deeper in potential trouble every time you post rubbish like this.   Here in Canada, you would be the one with the suspended account. and possibly have your computer taken away from you.

@patrickcooksey    As you can see nobody is believing your claims including this DJ who has taken the liberty to listen to both of the singles in question and even the Original single by The Rolling Stones, "As Tears Go By", and the three songs sound nothing alike at all.    
    I've spoken with a producer from the program, you question their integrity as well as Walt Winston's integrity and I can assure you from what I've heard, the vetting process that was taken, this claim is not only false but is pure garbage and I know their attorneys will most likely defend their reputation as well as Walt's integrity, as they told me they thoroughly vetted Walt Winston and all of the acts that have ever appeared on their program now in its eigth season.   

    The two singles are nothing alike as you claimed and in fact in the song list Mr. Winston presented to Freemantle Media, which they told me about and I personally listened to each and every one of the ten singles requested to them for him to perform and none of them are taken from any other artist and are deemed original and created by Walt Winston and his publishing company Wally Goat Music through BMI, which also confirmed that the music is Walt Winston's and does not belong to anyone else.    

    The unnamed producer also said, BMI had to check with them that the single actually aired which it did because it is their policy to vet each and every act before they would even have the chance to appear on the program.   

    I was also told, that Walt Winston went through a more thorough process than any act the program ever had because they had to verify so much information that was given from Mr. Winston and his representatives at Wally Goat Music as well as from MP3.com and Beta Records.com which VERIFIED everything that was sent to them as well as doing our own extensive research and found that Walt Winston did everything legal and proper.   I would not be surprised if the legal action would be taken against Mr. Cooksey, and THE RIVERFRONT TIMES,  instead of Wally Goat Music or Walt Winston as he has been found to be legally clear from any wrongdoing as were the producers at Freemantle Media.

    I read your same smear tactics being used on St. Louis Magazine's website before they had to close the comments because St. Louis Magazine said that if the comments made by you and others could get the magazine as well as you personally could be sued for libel and slander as you continue to slander this recording artist who in my opinion and the rest of the world's opinion that his music is his music and his alone

@patrickcooksey  I pasted Walt's response to show you that it is his material without question and I've proven that as has Walt Winston and others who had tried to prove the claim patrick and robert make without evidence.    

    You make the statements but you can't prove any of what you say?    Are the notes really note for note?   No way in hell are they the same.  In fact I think Walt's case is bolstered even further that you have to repeatedly beat your drum around the web and I've noticed that everyone involved and who's blog you've posted on has removed you or blocked you or pretty much took Walt's side in this.   That has to tell you something right there doesn't it?     
    The smart thing to do would to back away from your claims and not post any more rhetoric about your claim which was dismissed by everyone involved.  

   It sounds like ACCOUNT SUSPENDED will be more like cooksey's or eugene's accounts new tune.

@patrickcooksey@robert eugene   Again you're wrong on all counts.   I represent Mr. Winston, as  he came into my office at my request, as I read your rants and raves and decided to represent him pro-bono and I can prove that You've gone here, on St. Louis Magazine as well as youtube and elsewhere making your false allegations without any proof at all.   You also proved time and time again that you don't know what you're talking about and anytime you or anyone else wants to take him to court BRING IT ON!   We have a mountain of evidence that he indeed wrote the single.   We also have a witness who is willing to testify in a court of law that he indeed write the single, as the witness was the lead guitarist on the studio version of the single.   Would you like to talk with Chris Noblin the guitarist on the single?   Why not ask him who wrote both of the singles you claim were not written by their original artists.   

Mr. Noblin and I listened to both singles and I hate to burst your bubble but Marianne Faithful didn't write either single as you claim.   Why not check your own facts before you smear someone else who has the talent to write and perform his own music.      

  Now  let's look at your claim that note for note the singles are the same, boy you're way off base and I can prove it here.   The singles sound nothing alike at all, not even close.   

  Secondly, there is a vetting process that Freemantle Media who owns America's Got Talent! X Factor American Idol and other programs go through before they select an act to perform on their programs.   Freemantle Media, and BMI did their own research and knew that Walt Winston did write his single "Truck Drivers Aren't Supposed To Cry" otherwise he would not have been cleared to perform the single in question.   Have you even talked with any of the producers of the program "America's Got Talent!"   Obviously not as they VERIFIED that the single is his as part of the vetting process that every act goes through BEFORE they can even audition let alone perform in front of the judges.   

       Walt presented me a letter sent to him by Marathon Productions BEFORE the program aired in June of 2011 asking HIS permission to use the single to broadcast his performance in Minneapolis which was taped back in March of 2011.   This is needed for clearance for television as they also did their vetting process to make sure there would be no legal issues and to your surprise there were no legal issues.  Otherwise his performance would not have aired.   

     In case you didn't know this Robert, many DJ's that know Walt Winston heard both singles and all of them came to the conclusion that neither single sounds note for note as you claim, in fact far from it.   BMI would not have paid Mr. Winston for the writing and publishing of the music if he didn't write it.   Maybe you would like to see the royalty statement as verification that yes Winston did indeed write his single and it is his without question.   

    I don't know if you're aware of this either but Mick Jagger and Keith Richards wrote the single "As Tears Go By" not Marianne Faithful.    Do you even know who Marianne Faithful  is?   

     Now more facts for you to cry about.     In order to make the Top 400 which Mr. Winston did not once but twice.  Winston beat the odds of appearing in the Top one half of one percent out of over 75,000 acts that even auditioned for the program in both Seasons 6 & 7.   Walt joined an exclusive club with only 17 other acts that appeared on the program in more than one season.   

   That's right, robert, in spite of your claims of not having talent, he proved you wrong again.   Yes he appeared at the Fox Theatre in St. Louis for America's Got Talent! for Season 7 as "The Top Of The Bill!"   That's right, he closed the show for the program in St. Louis and though the performance didn't air and we know it's because of the royalties that he would have earned for another original single.   

   I was at that performance and had a front row seat and I enjoyed his performance.

boy, you sure can be fooled, can't you? his song sounds exactly like Marianne Faithfull's "As Tears Go By," listen to it--- note for note and you'll figure it out. you call that original? i call that a ripoff artist and there are far better acts to come out of Saint Louis than him! and contrary to popular belief, i wouldn't believe Christine for a moment-that's his fiance and Thunderdog, Folkfan and The Archer are all Walt Winston. do some fact digging before you publish such rubbish!

@robert eugene you want to see a ripoff artist!  Look in the mirror.    Nobody believes you at all.   In case you didn't know this I am not thunderdog, Folkfan or The Archer.   The Archer passed away about a year ago why not ask his wife who he was.    Why not ask Chris Noblin from Smokestack Lightning about the single he was the lead guitarist on the track, and he will tell you who wrote the single.   Jim Strickland from the same band and other truck drivers from Central Refrigerated can also tell you I wrote the single as I wrote the lyrics at the truck driving school when my oldest sister died and I couldn't attend her funeral.   Why not ask Linda of the UltraViolets who I know very well, and she could tell you who wrote the single.  As you can see nobody believes a word you say!

@walteria Walt has nothing to worry about!  This man is very talented and is one of a handful of acts that made it twice or more times to the program, and have you noticed that no media outlets are listening or investigating your claim?    The reason is simple because there is no claim!   Robert and Patrick are nothing more than the same person trying to cause a fake lawsuit to happen against this man who hasn't done anything wrong but is the victim of a smear campaign by people who are simply jealous of his accomplishments.

Anyone could have a bad day.  In spite of subzeros temps in Minneapolis in March which is not good on a vocalist and the older you are the worse things get.  He is 46 so we can't expect Justin Beiber here.   Besides, he's better than Beiber!

A guy, don't let the door hit you in the ass when you move back to Chicago where you belong (Wrigley Field) where the other losers like you go!    We love Walt here in St. Louis as know him and he's a great man and has done a lot.
