.262 is crazy high. It wouldn't have mattered if it was snowing, raining or if frogs were falling from the sky. She was not fit to drive. A kid died because she was waaay too drunk to drive and the construction didn't matter. I'd take it into consideration if her BAC was .08 or something, but .262 she shouldn't have been conscious, let alone driving around Delmar.
